1. Acceptance of these Terms
Welcome to Xfinder (the “Site”). By accessing, browsing, or using the Site, you confirm that you have read and agreed to these Terms of Use and Disclaimer and to the Privacy Policy. If you do not agree, you must not use the Site.
2. Age and Eligibility
The Site is intended exclusively for adults aged 18 or older. Minors are strictly prohibited from using the Site or being presented as advertisers or service providers. Users must not upload any image, video, text, identifying information, or other content involving a minor in a sexual, erotic, exploitative, or otherwise unlawful context.
3. The Site’s Role as a Neutral Classifieds Platform
Xfinder is a neutral advertising platform and classifieds board that displays user-generated content supplied by independent third parties. The Site and its operators do not create, commission, or provide the services described in listings; are not a party to any transaction, arrangement, or meeting between users; do not employ, dispatch, represent, or manage advertisers; and are not an agency, broker, or provider of sexual or personal services.
All communication and dealings between users take place directly between them, at their own initiative and risk. Publication of a listing does not constitute approval, endorsement, verification, sponsorship, or any guarantee by the Site regarding the advertiser’s identity, the legality, quality, or safety of an offer, or the accuracy of its contents.
4. Prohibited Uses and Content
Only lawful content and lawful services may be advertised on the Site. Users must not publish, offer, request, arrange, solicit, finance, or promote:
- Any direct or implied commercial offer to provide sexual services, an act of prostitution, or the consumption of prostitution, including content designed to circumvent this prohibition;
- Content or activity that violates Israel’s Prohibition of Consumption of Prostitution Services Law (Temporary Order and Legislative Amendment), 2019, the Israeli Penal Law, 1977, including provisions concerning advertising prostitution services, obscene publications, and the exploitation of minors, or any other applicable law;
- Any content involving a minor or a person whose age as an adult cannot reasonably be established;
- Human trafficking, coercion, exploitation, violence, threats, extortion, invasion of privacy, non-consensual recording, or distribution of intimate content without consent;
- Content that infringes copyright, trademarks, privacy or publicity rights, a court order, or any other third-party right;
- False or misleading information, impersonation, fraud, spam, malicious software, or any other unlawful activity.
5. Advertiser Responsibility
Each advertiser is solely responsible for the listing and for all communications or dealings arising from it. The advertiser represents that they are at least 18 years old; every person depicted in the content is an adult who voluntarily consented to its publication; the advertiser holds all required rights, permissions, and consents; and the content and described service are lawful and accurate.
The Site may request evidence of age, identity, consent, or ownership of rights and may suspend or remove content while a review is pending.
6. Verification, Safety, and Dealings Between Users
The Site does not guarantee that it will conduct background checks, verify identities, or review every listing before publication. Users must exercise independent judgment, avoid transferring money or sensitive information without appropriate verification, and comply with all applicable laws. The Site is not responsible for the conduct, statements, acts, or omissions of any advertiser or other user.
7. Notice and Takedown
Anyone who believes that content on the Site is unlawful, infringes their rights, violates copyright or privacy, involves a minor, or otherwise breaches these Terms should submit a notice through the contact form.
To help us review a notice promptly, please provide the exact URL of the relevant page, a description of the content and alleged violation, the basis of the claimant’s rights or authority, contact details, and a statement that the notice is submitted in good faith and that the information supplied is accurate.
The Site may temporarily or permanently remove or restrict access to content, request additional information, forward the notice to the advertiser, preserve relevant evidence, and report the matter to competent authorities when required or permitted by law. A knowingly false, misleading, or bad-faith notice may expose the person submitting it to liability.
8. Enforcement and Content Removal
Subject to applicable law, the Site may reject, edit, restrict, suspend, or remove any listing or account that violates these Terms or creates a reasonable concern of harm to a person, the public, or the Site. This right does not create a general monitoring obligation or a guarantee that every violation will be prevented.
9. Intellectual Property
The Site’s design, trademarks, software, and other proprietary materials belong to the Site’s operators or their licensors. Advertisers retain their rights in submitted content but grant the Site a non-exclusive, worldwide, royalty-free licence to host, copy, adapt, display, and distribute that content to the extent necessary to operate and promote the Site and enforce these Terms.
10. Disclaimer and Limitation of Liability
The Site and its content are provided “AS IS” and “AS AVAILABLE,” without any representation or warranty that the content is accurate, lawful, current, safe, uninterrupted, secure, or error-free.
To the fullest extent permitted by law, the Site and its operators will not be liable for direct or indirect damage, loss, expense, injury, or dispute arising from third-party content, communications or dealings between users, reliance on a listing, use of the Site, or the Site’s unavailability.
11. Indemnification
A user or advertiser who violates these Terms is responsible for their conduct and, to the extent permitted by law, will indemnify the Site’s operators against reasonable claims, damages, and expenses arising from submitted content, offered services, violations of law, or infringement of third-party rights.
12. Amendments, Governing Law, and Jurisdiction
The Site may update these Terms from time to time. The revised version will be published on this page and will apply from the date of publication. These Terms are governed by the laws of the State of Israel. Unless applicable law requires otherwise, the competent courts of Israel will have exclusive jurisdiction over disputes relating to these Terms or the Site.
